THIS DOCUMENT SETS OUT THE TERMS ON WHICH NOWTOPIA P.C. (“US”, “WE”, “OUR”) PROVIDES YOU (“YOU”, “YOUR”, “USER”) WITH ACCESS TO AND USE OF THE WEBSITE LOCATED AT [https://www.athensdrunktour.com/] (“WEBSITE”) TO BOOK TICKETS TO OUR EVENTS. PLEASE READ THESE TERMS CAREFULLY. YOU ACKNOWLEDGE AND AGREE THAT BY ACCESSING OUR WEBSITE OR TICKING THE “I ACCEPT ALL TERMS AND CONDITIONS” BOX, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU WILL NOT BE ABLE TO BOOK ANY OF OUR EVENTS AND SHOULD NOT ATTEMPT TO USE THE WEBSITE
Customers accept the terms and conditions at the moment of payment. It is at this point that a contract between Athens Drunk Tour (provided by Nowtopia P.C.) and the Client comes into existence. Athens Drunk Tour reserves the right to decline any booking at their discretion. The contract, including all matters rising from it, is subject to Greek Law and the exclusive jurisdiction of the Greek Courts. No employee of Athens Drunk Tour (Nowtopia P.C.) other than the managers has the authority to vary or omit any of these terms or promise any discount or refund.
1.1 The Website is owned and managed by Nowtopia P.C., trading as [Athens Drunk Tour].
1.2 We can be contacted by email at [[email protected]] or via the ‘Contact Us section of the Website.
1.3 By using the Website, you warrant that:
1.3.1 You are legally capable of entering into binding contracts;
1.3.2 You are not in any way prohibited by the applicable law in the jurisdiction in which you are currently located to enter into these Terms;
1.3.3 You are at least 18 years old. If you are under the age of 18, you must ask a parent or guardian over the age of 18 to enter into these Terms on your behalf. As a parent or guardian of someone under the age of 18, you are responsible for ensuring that person’s use of the Service is at all times in accordance with these Terms
The information contained in this Website has been prepared solely for the purpose of providing information about the various events/pub crawls offered on our Website from time to time (“Events”, “Pub Crawl(s)”) and making online bookings for tickets to Events / Pub Crawls (“Tickets”) and must not be used for any other purpose.
3.1 By accessing the Website you will be assuming all risks associated with the use of this Website, including risk of your computer, software or data being damaged by any virus which might be transmitted or activated via our Website or your access to it.
3.2 You will only use this Website for personal private use.
3.3 Availability of the Website may be impaired by conditions or circumstances that are beyond our control, including, without limitation, third party service providers, geographic or atmospheric conditions, local physical obstructions, software and hardware features or functionality of your personal computer operating system.
3.4 We rely on third party providers (such as network providers, data centres and telecommunication providers) to make the Website and the content therein available to you. Whilst we take all reasonable steps available to it to provide you with a good level of service, you acknowledge and agree that we do not promise that the Website shall be uninterrupted or fault-free at all times. We shall not be liable in any way for any losses you may suffer as a result of delays or failures of the Website.
3.5 We shall be entitled at our own discretion to suspend the Website (wholly or partly) for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades and shall not be liable to you for any losses, damages, costs or expenses arising from or in connection with any suspension or unavailability of the Website.
4.1 The published price of the Ticket (“Price”) includes any applicable taxes, but is exclusive of booking or collection fees. You shall be notified of the booking and/or collection fee on the payment page of the Website.
4.2 If you have a promotional or discount code (“Code”), you may enter it on the relevant page of the Website prior to payment of your Tickets. We do not warrant or provide any guarantees that your Code will be accepted by the Website. If your Code is accepted by the Website, the Price will be adjusted accordingly. A Code can only be accepted at the time an Order is made and cannot be applied retrospectively.
4.3 Due to the nature of the business, you acknowledge and agree that the Price may be subject to change and variation from time to time. Any changes in the Price shall not be applicable to you once you have received Order Confirmation from us, save in the case of an obvious error.
4.4 In order to book and purchase Tickets to one of our Events / Pub Crawls, you shall be required to follow the process on our Website and complete the relevant details we require to confirm purchase of your selected Tickets via the Website (“Order”). Group bookings for Tickets shall be treated the same as individual bookings. You will be asked to provide customary billing information such as name, billing address and credit card information either to us or our payment processor. You agree to pay for your Order by one of the methods described on the Website. You hereby authorise the collection of such amounts using the method selected by you through the Website, either directly by us or indirectly, via our payment processor. If you are directed to our payment processor, you may be subject to terms and conditions governing use of their service. Please review such terms and conditions before using the processing services.
4.5 Your Order constitutes an offer to us to buy Tickets. All Orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email attaching your Tickets subject to the Order (“Order Confirmation”). The contract between us will only be formed when we send you the Order Confirmation (“Contract”).
4.6 It is your responsibility to check the Tickets that are subject to your Order and we are under no obligation to rectify any mistakes once the Contract has been formed in accordance with clause 4.5 above.
4.7 We will not be responsible for any Tickets that are lost, stolen or destroyed. Tickets are emailed to the address you supply to us at the time of placing an Order. You are responsible for ensuring your e-mail address is accurate. We are not responsible for Tickets sent to incorrect email addresses input by you.
Tickets will be supplied by email. It is your responsibility to print the Tickets prior to the date of the event or show valid Tickets on your mobile device. You may not be admitted to the Tour without presenting a valid Ticket. We shall not be liable for any failure by you to print or show valid Tickets.
6.1 Cancellation fee / refund:
– Cancellation between 14 and 7 calendar days before the services begin: You will be charged a 25% cancellation fee.
– Cancellation within 6 calendar days before the services begin: You will be charged a 100% cancellation fee (no refund).
6.2 Unless otherwise expressly stated in these Terms, you will not be able to cancel an Order after it has been accepted by Us, nor are you entitled to a refund for any Tickets purchased by you, even if you are unable to attend the Tour.
6.3 There will be no refund for lost or stolen Tickets.
6.4 Athens Drunk Tour reserves the right to cancel a tour at our discretion and for any reason. In the event of a cancellation, Athens Drunk Tour will try to contact distributors and clients as quickly as possible and will refund or replace tickets where appropriate.
6.5 We will notify you if an Event / Pub Crawl is cancelled or rescheduled, but you acknowledge and agree that it is your responsibility to ensure you have entered the correct contact details so we can notify you. We will not be liable for any losses you incur as a result of supplying us with incorrect contact details (e.g. e-mail address or mobile number).
6.6 All Tickets are non-transferable.
7.1 Our Events / Pub Crawls may include admissions to third party venues, including cafes and drinking venues (“Venue”). You shall comply with all policies, procedures and safety announcements in force on the Event / Pub Ceawl and at any Venue, including any security procedures in place from time to time. It is your responsibility to notify Venues and your assigned event host of any allergies or dietary requirements. We shall not be liable for any loss or injury suffered by you caused by a Venue.
7.2 You are responsible for arranging all transportation to and from the Event / Pub Crawl.
7.3 We reserve the right to refuse you admission without refund to any Event / Pub Crawl or eject you from an Event / Pub Crawl on account of your late arrival, being (or appearing to be) under any specified age, abusive, threatening, drunken or other antisocial behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorised audio, video or photographic recordings. Any guests arriving to events visibly intoxicated may be refused entry with no refund given.
7.4 It is your sole responsibility to ensure you comply with local laws when on our Events / Pub Crawls (e.g. legal age for alcohol consumption).
7.5 Tickets ordered through the Website are only for your personal use and that of your party. We reserve the right to cancel Tickets purchased if there is, or if we suspect there is, any resale, purported resale or attempted resale of Tickets. This includes but is not limited to Tickets being resold via internet auction sites. The holder of a resold Ticket may be refused entry or rejected from the Event / Pub Crawl without refund.
7.6 We operate a 3 strike policy to relieve our staff from repeated intolerable behaviour. This includes, but is not limited to:
– Unwanted physical contact towards any employee, partner or supplier to the company.
– Public disturbance
– Vandalism and damage to public property and that which otherwise does not belong to a member of the party
– Indecent exposure
– Disregard for public safety
7.7 Our Event Staff are all instructed to stop the event immediately once a group or individual has received their third warning throughout the period of the booked activity and evict the offending guest from the boat at the closest dock or from the crawl. If this occurs, no refund will be awarded.
7.8 All participants are responsible for their own safety and well-being during the event. Athens Drunk Tour will do its best to ensure that participants safely attend a variety of localities and venues within Athens. However, Athens Drunk Tour events cannot mitigate every eventuality and as such, Athens Drunk Tour events involve an element of possible risk. All participants acknowledge these risks and attend events of their own accord and solely at their own risk.
7.9 Athens Drunk Tour events include opportunities for participants to consume alcohol at their own discretion. Athens Drunk Tour urges all participants to drink responsibly and cannot accept any responsibility or liability if participants drink excessively, resulting in damages, ill health, injury or death.
7.10 All participants should be aware of their own physical or mental limitations before attending an event. People with medical conditions or who are pregnant are strongly advised not to participate in Athens Drunk Tour events and must inform Athens Drunk Tour of the full nature of their condition before participating.
7.11 All Athens Drunk Tour participants must be 18 years or older. Only official identification will be accepted as proof of age and includes: Passports, driver licences, proof of age (18 plus) cards, etc. Unacceptable identification includes photocopies, student cards and other non-government issued identification.
7.12 All tickets must be purchased before you may participate in Athens Drunk Tour events. Tickets purchased from distributors (hostels, accommodation providers, online sales, etc) will be redeemed for a wristband at the meeting point. Therefore, your Athens Drunk Tour wristband is your ticket to our events, and is subject to our Booking Terms & Conditions, Code of Conduct & Operating Policy.
7.13 We are not responsible for any loss or damage that is not foreseeable
8.1 Being drunk is not an excuse for not following the code of conduct.
8.2 We all like to drink, but no friend wants to ruin their night by having to look after another. Please know and stick to your limits!
8.3 As with most countries in the world, drug use and the buying of drugs is illegal. Please do not ask any of our Event Staff or activity partners to help get you drugs. Being caught carries a HUGE penalty, including jail time. Please do not put our staff in this position.
9.1 Athens Drunk Tour reserves the right to change or modify events / pub crawls without notice, including changing or altering venues and routes. In the event of a change, Athens Drunk Tour will endeavour to substitute comparable venues, but accepts no liability for changes.
9.2 Athens Drunk Tour accepts no liability for participant’s behaviour and reserves the right to refuse entry or remove from events anyone who is drunk, disorderly, aggressive, abusive or anti-social. In the event of refusal or removal, V will not refund ticket prices or cover any additional costs incurred by participants as a result.
9.3 The participant agrees to indemnify Athens Drunk Tour (it’s employees, directors, suppliers, agents, distributors, representatives, etc) against any third party claims as a result of the participant’s behaviour and actions. Any damages or loss caused by a participant is solely the participant’s responsibility.
9.4 All venues (including bars and clubs), attended by Athens Drunk Tour reserve the right to refuse entry or remove participants from venues for any reason including drunk, disorderly, aggressive, abusive or anti-social behaviour. Athens Drunk Tour accepts no liability in the event of refusal or removal and will not refund ticket prices in such an event.
Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. Clients making their own arrangements should ensure that there are no exclusion clauses limiting protection for the type of activities in their tour.
11.1 Athens Drunk Tour events suit outgoing and energetic people. All Clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of the event / pub crawl. Athens Drunk Tour reserves the absolute right to decline a booking at their discretion. Clients agree to accept the authority and decisions of Athens Drunk Tour’s employees, event staff, and affiliates whilst on the event with us. If, in the opinion of such a person, the health or conduct of a Client before or after the departure appears likely to endanger the safe, comfortable or happy progress of the event / pub crawl, the Client may be excluded from all or part of the event / pub crawl. On Athens Drunk Tour tours large quantities of alcohol are often consumed. All clients are responsible for their own safety and well-being. Athens Drunk Tour does not encourage any clients to engage in any dangerous activity or to drink excessively. Athens Drunk Tour cannot accept any responsibility if the client drinks too much or engages in dangerous activities and suffers injury, illness, death, loss or damage as a result.
11.2 Illness or Disability:
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment required during the event / pub crawl. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the event / pub crawl in which case all monies paid will be forfeit. This will not prevent the Client from participating in the event / pub crawl but will enable Athens Drunk Tour to take additional precautions for the Client’s safety and enjoyment at such times as may be appropriate.
Greek Laws and Behaviour
All participants in Events / Pub Crawls operated by Athens Drunk Tour are expected to obey Greek laws and regulations and any failure to do so will relieve Athens Drunk Tour of all obligations that they may otherwise have under these booking conditions. Any damage or losses caused by a Client is the responsibility of the Client. Full payment for any such damage or loss must be paid at the time direct to the accommodation owner or manager or other supplier. If the Client fails to do so, the Client will be responsible for meeting any claims (including legal costs) subsequently made against Athens Drunk Tour as a result of the Clients actions. Athens Drunk Tour expects the Client to have consideration for other people. If, in Athens Drunk Tour’s opinion, any Client behaves in such a way as to cause or be likely to cause danger, annoyance or distress to any third party or damage to property, Athens Drunk Tour is entitled, without prior notice, to terminate the event of the Client concerned. In this situation, the Client concerned will be required to leave the event / pub crawl. Athens Drunk Tour will have no further responsibility towards the Client. No refunds will be made and Athens Drunk Tour will not pay any expenses or costs incurred as a result of the termination.
If you Have a Complaint
If the Client has a complaint about any of the event / pub crawl arrangements the Client must bring it to the attention of the event / pub crawl leader at the time so that they may use their best endeavours to rectify the situation. It is only if Athens Drunk Tour is made aware of any problems that there will be the opportunity to put things right. Failure to complain on the spot will result in the Client’s ability to claim compensation from Athens Drunk Tour being extinguished. Should the problem remain unsolved a complaint must be made in writing to Athens Drunk Tour within 5 days of the completion of the event / pub crawl.
The events / pub crawls operated or supplied by Athens Drunk Tour have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of potential risk and exposure to potential hazards. All bookings are accepted on the understanding that such risks and hazards are appreciated by the Client and that they undertake all events / pub crawls at their own will.
15.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement that is caused by an Event Outside Our Control.
15.2 What we mean by an Event Outside Our Control:
An “Event Outside Our Control” means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
15.3 If an Event Outside Our Control takes place that affects the performance of our obligations to you:
– we will contact you as soon as reasonably possible to notify you; and
– our obligations to you will be suspended and we reserve the right to cancel any events / pub crawls affected by the Event Outside Our Control.
16.1 We have the right to revise and amend these Terms from time to time, including but not limited to making changes to reflect current market conditions affecting our business, changes in technology, changes in payment methods and changes in relevant laws and regulatory requirements.
17.1 Nobody else has any rights under these Terms. These Terms are between you and us. No other person shall have any rights to enforce it. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these Terms.
17.2 If a court finds part of these Terms invalid or unenforceable, the rest will continue in force. Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.
17.3 Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
17.4 Which laws apply to these Terms and where you may bring legal proceedings. These Terms are governed by Greek law and you can bring legal proceedings in respect of any dispute arising under these Terms in the Greek courts.
17.5 Only these Terms apply between you and us. These Terms and any document expressly referred to in them represent the entire agreement between you and us in respect of your use of the Website and the booking of Events and shall supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.
17.6 Athens Drunk Tour does not provide automatic access to venues. Please remember that our staff has no power over the decision of the security bouncers at each location, and no intervention by us to overrun it can be expected.
